These Terms of Service (“Terms”) govern your use of the website roselarkpetproducts.co.uk (the “Site”) and the purchase of products from RoseLark Pet Products (“we”, “us”, “our”).

By using our Site or placing an order, you agree to these Terms.

If you do not agree, you must not use the Site.

We are a UK-based small business supplying pet products.

2. Eligibility

You must be at least 18 years old to place an order. By placing an order, you confirm that:

  • You are legally capable of entering into binding contracts

  • The information you provide is accurate

3. Products & Descriptions

We make every effort to ensure product descriptions, images and pricing are accurate.

However:

  • Colours may vary slightly due to screen settings

  • Handmade or natural products may vary slightly in appearance

  • Minor errors may occasionally occur

If we discover an error in pricing or description, we will contact you before processing your order.

4. Orders & Contract Formation

When you place an order:

  1. You are making an offer to purchase goods.

  2. You will receive an order confirmation email.

  3. A legally binding contract is formed only when we dispatch the goods.

We reserve the right to refuse or cancel orders where:

  • Payment is not authorised

  • There is a pricing error

  • The item is out of stock

  • Fraud is suspected

If cancelled, you will receive a full refund.

5. Pricing & Payment

  • All prices are listed in GBP (£).

  • Where applicable, VAT is included in the price.

  • Delivery charges are displayed at checkout.

We accept payment via Shopify-supported payment providers.

Payment must be received in full before dispatch.

6. Delivery

Delivery times are estimates and not guaranteed.

We are not responsible for delays caused by:

  • Postal services

  • Customs (for international orders)

  • Events outside our control

Risk in goods passes to you upon delivery.

Ownership transfers once full payment is received.

7. Consumer Cancellation Rights (UK Customers)

If you are a UK consumer, you have the right to cancel your order within 14 days of receiving your goods under the Consumer Contracts Regulations 2013.

To cancel, you must notify us clearly (for example, by email).

You then have 14 days from cancellation to return the goods.

You are responsible for return postage costs unless the item is faulty or not as described.

We will issue a refund within 14 days of receiving the returned goods (or receiving evidence that they have been returned).

Exceptions

The right to cancel does not apply to:

  • Custom-made or personalised items

  • Sealed goods which are not suitable for return for hygiene or health protection reasons once unsealed

  • Perishable goods, including natural sprays, dried forage, or other plant-based enrichment products that may deteriorate or expire

  • Goods which become mixed inseparably with other items after delivery

This does not affect your statutory rights. If goods are faulty, misdescribed, or not of satisfactory quality, you remain entitled to remedies under the Consumer Rights Act 2015.

8. Faulty or Misdescribed Goods

Under the Consumer Rights Act 2015, goods must be:

  • As described

  • Of satisfactory quality

  • Fit for purpose

If a product is faulty, you may be entitled to:

  • A repair or replacement

  • A refund

Please contact us promptly if you believe an item is faulty.

9. Use of Our Products

Our products are designed for small pets. It is your responsibility to:

  • Supervise pets appropriately

  • Use products safely and as intended

We are not liable for injury or damage resulting from misuse or failure to supervise pets.

Nothing in these Terms limits liability where it would be unlawful to do so.

10. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any matter which cannot legally be excluded

Subject to the above, our liability shall be limited to the purchase price of the goods.

11. Intellectual Property

All content on this Site, including:

  • Images

  • Logos

  • Product descriptions

  • Branding

is owned by or licensed to RoseLark Pet Products.

You may not copy, reproduce or distribute content without permission.

12. Privacy

Your personal data is processed in accordance with our:

13. Force Majeure

We are not liable for failure to perform obligations due to events beyond our reasonable control, including:

  • Natural disasters

  • Postal strikes

  • Supply chain disruptions

  • Government restrictions

14. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a UK consumer, you may bring legal proceedings in your local UK court.

International customers agree that disputes shall be subject to the jurisdiction of the courts of England and Wales.
